WOLLMAN, Circuit Judge.
Wayne Robert Haggerty appeals from the district court’s 1 denial of his motion to dismiss the indictment charging him with illegal reentry into the United States after deporta tion subsequent to a prior aggravated felony, in violation of 8 U.S.C. §§ 1326(a) and 1326(b)(2). We affirm.
