It appears from the record that the action of the commission which is complained of by the petitioner was had pursuant to an attempt and plan on the part of the commission to straighten a primary road known as the Lincoln Highway, and as State Highway No. 30, extending from the city of Clinton to the city of Council Bluffs. The intended acts of the commission purported to be for the purpose of improving the highway, and as a preliminary aid to its further improvement and construction by the grading, draining, and paving thereof.
