The action is in replevin for the possession of a diamond ring given by the plaintiff to the defendant under the following circumstances:
The plaintiff was paying attentions to the defendant, and on .October 18, 1895, there was an engagement party at her house, the parents and friends of both parties being present, and there was a banquet in honor of the occasion.
