Defendants in error, F. R. Allison, L. Kaffie and W. F. Harris, who will be referred to herein as plaintiffs, instituted this suit in the District Court of Nueces County against plaintiffs in error, L. B. Griffith and wife, Illse Griffith, C. G. Sanford and wife, Lucile Sanford, M. C. Gann and W. E. Pope, who will be referred to herein as defendants.
