Henry J. Goggin died testate, naming his mother, Maria A. Goggin, sole legatee and executrix. The will was probated, the mother qualified as sole executrix and shortly thereafter died testate, naming her daughter, Agnes M., sole legatee and executrix. Such will has been duly proved and the daughter, Agnes M., has qualified as sole executrix and now petitions to be appointed administratrix cum testamento annexo, on the estate of her brother Henry J., and her only brother Thomas joins with her in such application.
