The claimant in this workmen’s compensation case met with an accident, on April 10, 1936, in the course of his employment and the employer entered into an open agreement with him for total disability. On October 1, 1937, the employer petitioned for a modification of the agreement, alleging that claimant was only partially disabled. The referee held that he was entitled only to partial disability after September 30, 1937.
