In an action, inter alia, to recover damages for breach of contract and fraud, the defendants appeal, as limited by their brief, from so much of an order of the Supreme Court, Kings County (I. Aronin, J.), dated June 11, 1996, as denied their cross motion for summary judgment dismissing the complaint.
Ordered that the order is modified by deleting therefrom the provision denying those branches of the defendants’ motion which were for summary judgment dismissing the second and fourth causes of action, and substituting therefor a provision granting those branches of the motion; as so modified,…
