MEMORANDUM OPINION AND ORDER

THIS MATTER comes before the Court on the Defendant’s Motion and Memorandum to Suppress Evidence, filed October 3, 2011 (Doc. 24)(“Motion”). The Court held an evidentiary hearing on November 16, 2011. The primary issues are: (i) whether the Albuquerque Police Department (“APD”) officers lacked reasonable suspicion to conduct an investigatory stop to question Defendant Manuel Rodriguez; (ii) whether Terry v.
