BOOKHOUT, Associate Justice.

This suit was instituted by J. B. Walters against the Pacific Express Company and J. A. Russ, in the District Court of Yan Zandt County, on March 22, 1904, to recover the sum of nineteen hundred dollars, alleged damages for breach of contract of employment.

The plaintiff alleged that the defendants, on the 6th day of October, 1903, employed him to work as a messenger in Texas, at a salary of $80 per month, for twelve months.
