CAFFEY, District Judge.
For the present purpose it will be assumed, as is urged by the plaintiff, that in the departmental title, Managers’ Round Table Club, of the Motion Picture News and the Motion Picture Herald, the words Round Table have long ago gained and now have a secondary significance in the motion picture industry; that a department under this title has been conducted continuously in the News or the Herald ever since May, 1928; that from May, 1928, to March, 1933, when first the News and then the Herald were making-use of such title, the defendant Lewis was in the employment of its…
