George W. Latimer, Judge:

The above-named accused were charged jointly with the offenses of attempted robbery in violation of Article 80, Uniform Code of Military Justice, 50 USC § 674, and felony murder in violation of Article 118, Uniform Code of Military Justice, 50 USC 712. At the time the case was referred to a general court-martial for trial, the convening authority directed that it be considered as a noncapital offense. The accused were found guilty, and because the Code fixed the punishment, they were sentenced to life imprisonment. However, all members, of the…
