Proceedings were had in the County Court of Clear Creelc County in relation to the settlement of a certain estate. Prom the determination of some issue in controversy therein, an appeal was taken to the district court, which, upon a hearing thereof, found that certain moneys, goods and chattels of the estate were in the possession of the plaintiff in error, W. T. Hughes, and other persons named.
