I. Introduction

This matter comes before the Court on two motions to dismiss filed by the Defendants pursuant to Federal Rule of Civil Procedure 12(b)(6). (ECF Nos. 7 & 9). The motions collectively seek the dismissal *379of all claims brought by the Plaintiff. For the reasons that follow, both motions will be granted in part and denied in part.
