This matter is before the Court on the defendant II Diamond Motors’ motion for summary judgment and defendant Robert B. Andre’s motion entitled “Rule 12(b)(6) motion to dismiss and/or motion for summary judgment on RICO claims.” Because the Court has considered and relied on evidence outside of the pleadings, the Court will treat the defendant’s motion to dismiss the RICO claims as a motion for summary judgment.
