Plaintiff in error, who was defendant in the court below, was indicted by a grand jury in Clay County for the violation of Section 7657, Comp. Gen. Laws; was found guilty, and a judgment of conviction and sentence to the penitentiary imposed. The indictment charged that the defendant, in a place known as the Silver Wing Club, a certain building in the town of Orange Park, in said county, had unlawfully kept and maintained in his' possession a gaming table and other gaming instruments or apparatus, therein described, for the purpose of gaming or gambling.
