Appeal from a judgment of the Supreme Court, Onondaga County (James P Murphy, J.), entered September 26, 2011. The judgment awarded costs and disbursements to defendants.

It is hereby ordered that the judgment so appealed from is unanimously modified on the law by denying the motion in part, and the third amended complaint, as amplified by plaintiffs response to defendants’ interrogatories, is reinstated to the extent that it seeks damages for loss of rent based on legal malpractice and as modified the judgment is affirmed without costs.
