For convenience the parties to this suit will be designated here as they were in the trial court. The action was commenced by the plaintiff against the defendant to recover damages in the sum of $3,000 on account of personal injuries received because of the negligence and carelessness of the defendant to put proper emergency brakes in a certain automobile the plaintiff purchased from the defendant.
