Cosgrove v. Bowen
District Court, S.D. New York
1Opinion of the Court
GOETTEL, District Judge.
The defendants move to reargue this Court’s opinion dated December 22, 1986, reported at 649 F.Supp. 1433 (the “Opinion”). The defendants also move to dismiss the claims of plaintiff Nancy Leila, because her alleged injury occurred on March 24, 1984, a date outside the relevant time period established in the Opinion. Since the plaintiffs consent to the severance and dismissal of plaintiff Leila, we need not further consider that portion of the defendants’ motion. The plaintiffs oppose reargument, and move for entry of final judgment and for class certification.
