This cause is presented on appeal from the district court of Carter county. It was instituted by the State of Oklahoma ex rel. Rutherford Brett, County Attorney, et al. against Rosa Elliott Crain and Eliza Frayer to cancel a deed which had been issued by the chairman of the board of county commissioners of Carter county.
The plaintiff’s petition alleged that lot 8, block 478, in the city of Ard-more, had been sold at tax resale to Carter county and in 1939 was conveyed to one Virgil Harris by deed executed by the chairman of the board oí county commissioners. That Virgil Harris had conveyed…
