MEMORANDUM OPINION

SUSAN PIERSON SONDERBY, Bankruptcy Judge.

Plaintiff Glucona America, Inc. (“Gluco-na”) moves for summary judgment on all counts of its complaint against Debtor Kenneth Ardisson (“Ardisson”). For the reasons set forth below, the motion is denied.

BACKGROUND

Ardisson, a chemical engineer, was employed by Glucona in 1996 to function initially as its managing director. Later, in 1997, Ardisson became president of Gluco-na and managing director of Glucona’s parent corporation, Glucona, B.V. (“B.V.”).
