This matter comes before the Court on Plaintiffs’ Motion for Class Certification, filed pursuant to Federal Rules of Civil Procedure 23(a) and 23(b)(2), and Defendant’s Motion in Opposition to Plaintiffs’ Motion for Class Certification.1 Plaintiffs seek to certify a class defined as: all consumers who have received or will receive, at any time on or after December 13, 1997, from Defendant Jack E.
