The original declaration in this case was filed on August 6, 1930, and consisted of three counts. In the first and second counts it ivas alleged that on January 11, 1930, the defendant railway company was a common carrier engaged in interstate commerce and that plaintiff ivas employed by the defendant as a switchman engaged in interstate commerce.
