ANDREWS. J.
This is an appeal from a judgment of the district court of Oklahoma county in favor of the defendant in error, who was the plaintiff therein, and against the plaintiff in error, who was the defendant therein.
Under the issues, the burden of proof was on the defendant. At the conclusion of the evidence offered by the defendant, the plaintiff demurred thereto and'moved for a directed verdict, and, over the objection of the defendant, the trial court directed the jury to return a verdict in favor of the plaintiff.
