OPINION
ROBERT L. CARTER, District Judge:
In administrative proceedings before a hearing officer appointed by the New York State Commissioner of Education, plaintiff Clifford Burr challenged the recommendation of the New York Institute for the Education of the Blind (“the Institute”) that he not be appointed to its program for the handicapped. The hearing officer directed plaintiff’s admission to the Institute’s program, and awarded plaintiff a year of free public education to compensate him for the delay in his placement.
