This is an appeal from a dismissal for failure to state a claim. The plaintiffs, The Reverend Father John P. O’Malley, O.S.A., and James A. Nesbitt, brought suit against The Reverend Father Patrick H. O’Neill, O.S.A., St. Thomas of Villanova University, the Board of Trustees of St. Thomas University, and two of the trustees in their individual capacities, for damages and equitable relief arising from alleged violations of the Racketeer Influenced and Corrupt Organizations Act of 1970, 18 U.S.C. § 1961 et seq.
