Appellee was indicted for possession of cocaine. Appellee filed a motion to suppress the evidence challenging the legality of the search of his automobile and its contents. The trial court granted his motion and the State appealed. See Article 44.01(a)(5), V.A.C.C.P. The Court of Appeals reversed and remanded the cause to the trial court State v.
