This action is before the court now on defendants’ motion for summary judgment. Plaintiff’s claim seeks compensatory and punitive damages for violations of federal securities laws, fraud, and breach of a fiduciary duty owed by defendants to Sara Johnson Turner. Defendants’ motion, originally filed as a motion to dismiss and converted to one for summary judgment by this court’s order of December 15, 1982, asserts four grounds for dismissal.
