John Baker was convicted of murder in the second degree for the killing of Norman Swoboda and sentenced to serve a term in the penitentiary. To review the judgment he brings the case here by writ of error.
The evidence disclosed that defendant was twenty-four years of age and resided in Golden, Colorado, with his wife and baby daughter. Until shortly before December, 1943, he had been employed in construction work outside the state of Colorado, and upon his return to Golden was employed as a mechanic.
