Petitioner, Sue Ann Maldonado, seeks a writ of mandate to compel respondent superior court to grant her a trial by jury on her appeal de novo from a judgment rendered against her in an unlawful detainer action brought in the small claims division of the municipal court. Following issuance of an alternative writ, respondent superior court filed its return denying petitioner’s claim of right of trial by jury.
