THIS MATTER comes before the Court on the “Plaintiffs Objection to Magistrate’s Recommendation and Report on Defendant’s Motion to Dismiss Second Amended Complaint” [D.E. 57]. The Defendant filed a response essentially arguing that the objections, with the exception of its “Introduction” and the last sentence of its “Conclusion” were verbatim reproductions of Plaintiffs Response to Celebrity’s Motion to Dismiss the Second Amended Complaint [D.E. #45].
