CURTIS, Circuit Justice.

This is a bill in equity, filed by David A. Fisher, a citizen of Massachusetts, against' Henry H. Boody, Freeman Bradford, and Joseph Russell, citizens of Maine, to set aside a sale and conveyance of land, on the ground of fraud. The material allegations of the bill, upon which the claim to relief is rested, are, that the defendants, claiming to be the owners of a tract of land in the state of Maine, containing six thousand six hundred and ninety-four acres, known as the ‘Bog Brook.
