On November 8, 2005, the magistrate judge, in a written opinion, recommended that Defendant’s motion for summary [Doc. # 12] be granted and that judgment be entered dismissing this action. On that same date, the Clerk of this court served a copy of the magistrate judge’s recommendation on the Plaintiff and specifically noted that any objections to the recommendation must be filed and served by November 28, 2005.
