The plaintiff, school district, seeks recovery from the defendant, heating company, for damages for alleged defective thermostatic equipment installed by it as a part of the heating and ventilating equipment contracted to be installed by it in one of the district’s large high school buildings. The case proceeded to trial in the superior court for King county sitting with a jury. At the conclusion of the introduction of evidence in behalf of the respective parties, counsel for each moved the court to take the case from the jury and decide the case in its favor as a matter of law.
