OPINION AND ORDER

Pending before the Court is Jorge An-dujar-Ortiz’ (“Defendant”) Motion to Suppress. (Docket No. 42). For the reasons set forth below, the Court DENIES the Motion.

FACTUAL AND PROCEDURAL BACKGROUND

Defendant stands charged in an Indictment returned by a Grand Jury for violations of 21 U.S.C § 841(a)(1) and 18 U.S.C. §§ 924(c)(1)(A) and 922(g)(1).
