ORDER
HOWARD, Chief Judge.
This matter is before the Court on the “Plaintiffs’ Motion to Remand this Case to the Circuit Court of Mobile County, Alabama.” [Doc. #7] For the reasons that follow, the motion to remand is DENIED.
I. FACTS
It appears to the Court from the pleadings and the affidavits filed by the defendants in support of their motion for summary judgment that the facts of this case are as follows.
