The court entered judgment dismissing plaintiff’s action “for failure of the plaintiff to keep up alias summons, and for a break in said summons,” and, from an inspection of the record, finds the following facts in support of the judgment:
“That a summons as issued in this cause, entitled as above, on 9 November, 1918; that same was returnable to the November Term, 1918, of the Superior Court of Madison County, and that said term convened on 25 November, 1918.
