' This was an action in tort for damages alleged to have been sustained by the plaintiff as the owner of a certain automobile, which was driven by an agent of the plaintiff onto the tracks of defendants, in the city of Columbia, where there was no street crossing, but which point was near a street, or proposed street, which had been constructed by private parties, with certain assistance from the city of Columbia, who was a defendant also iri the case, on the ground that the city of Columbia built and opened up the…
