Plaintiffs appeal from an order granting summary judgment in favor of Manufacturers National Bank of Detroit based on plaintiffs’ failure to state a cause of action, GCR 1963, 117.2(1), and because there did not exist any mate rial issue of fact, GCR 1963, 117.2(3). The motion was granted based on plaintiffs’ amended complaint, certain depositions hereinafter mentioned and an affidavit by counsel for defendant bank, all of which collectively considered established the following basic facts.
