MEMORANDUM OPINION

HEYBURN, District Judge.

This case comes before the Court on cross-motions for summary judgment. Plaintiffs, owners of Texaco service stations, seek a declaratory judgment against the Department of Energy and other agency officials challenging the agency’s final action on the implementation of special refund procedures for the disbursement of $1,198 billion that the agency secured from Texaco, Inc. in settlement of agency enforcement actions.
