Plaintiff, an anesthesiologist, has commenced this action for declaratory, injunctive and monetary relief against the following defendants: Champlain Valley Physicians Hospital Medical Center (hereinafter the “hospital”), its President, David T. Han-nan, its Chief of Staff, Michael J. Moynihan, Anesthesia Associates of Plattsburgh, P.C. (hereinafter “AAP”)> its President, John Menustik and the hospital’s Chief of Anesthesiology, Salem Bayoumy.
