This is an application for a writ of error coram nobis brought on behalf of the defendant, George Macchi.
On July 31,1963, the defendant was arrested by the New York State Police for a violation of section 986-b of the Penal Law, the possession of book-making records, a misdemeanor. On the same day, in fact almost simultaneously, five other individuals were also arrested by the New York State Police, their charges being gambling in one form or another.
