*1054In an action, inter alia, for the return of a downpayment given pursuant to a contract for the sale of real property, the plaintiffs appeal from an order of the Supreme Court, Rockland County (Nelson, J.), dated May 26, 2006, which granted the defendants’ motion for summary judgment dismissing the complaint and for summary judgment on the second counterclaim to retain the downpayment.
Ordered that the order is affirmed, with costs.
