MEMORANDUM OF DECISION
MARK R. KRAVITZ, District Judge.
In this case, John Smith, a former employee of the Town of Branford, Connecticut, sues the Town of Branford and Bran-ford’s First Selectman, Anthony Da Ros, under both Connecticut General Statutes § 31-51q and 42 U.S.C. § 1983, claiming that the Defendants retaliated against him for exercising his First Amendment rights. Mr. Smith’s Complaint [doe. # 1] originally included a federal procedural due process claim as well, but Mr. Smith has “agree[d] to withdraw” that claim. Mem. in Opp’n [doc. # 39] at 35.
