OPINION AND ORDER

CONNER, District Judge.

This is an appeal from a determination by Bankruptcy Judge Joel T. Lewittes that appellant is an unsecured creditor of the debtor-appellee. Presently before the Court is appellee’s motion to dismiss appellant’s notice of appeal on the ground that it was untimely filed.

The following facts are undisputed except as otherwise indicated. In an Opinion dated September 28, 1979, Judge Lewittes held that appellant is an unsecured creditor. The Opinion directed the parties to settle an order on three days’ notice in conformity with the Opinion and such an order…
