ORDER DENYING DEFENDANT PHAR-MOR’S MOTION TO DISMISS
PITTMAN, Senior District Judge.
This case is before this court on defendant Phar-Mor’s motion to dismiss. This action was filed in Circuit Court on November 7, 1991, and removed to this court on the basis of diversity on December 26, 1991. The plaintiffs, Helen Griffin and Richard Griffin, claim that defendants (Phar-Mor and two pharmacists) misfilled a prescription for Mrs. Griffin on two occasions: October 13, 1989, and November 29, 1989.
