This action is brought to establish and enforce a resulting trust in favor of Henry Midmer, Eliza Anderson, and William Midmer, and against the executors of John H. Midmer, deceased, to certain lands situate in the county of Hudson. The lands in controversy were, by the will of the testator, devised in trust, to his widow7 Theodosia Ann, his brother William, and his friend Leon Abbett, who are the executrix and executors thereof, and also the defendants in this suit.
