I. Introduction.
The defendant has moved for dismissal of the complaint pursuant to Federal Rules of Civil Procedure 12(b)(2) and 56, on the grounds that the court lacks jurisdiction over the person of the defendant, and the action was not commenced within the applicable statute of limitations.
