This is an action of assumpsit brought by the plaintiff in error against O. Y. Bargamin and sixteen other persons-, as partners *66doing business under the firm name and style of the Virginia Abstract Company.
The defendants filed several pleas, among them a plea denying they were partners as averred in the declaration.
It appears that, in November, 1894, five of the defendants, under the provisions of section 1145 of the Code, obtained a charter from the Circuit Court for the city of Richmond, creating them, and tlieir successors, and such other…
