MEMORANDUM OPINION AND ORDER
SPRIZZO, District Judge.
In this action for a declaratory judgment, plaintiff Paco Sport, Ltd., (“Paco Sport”) 1 seeks a declaration that its use of the trademarks PACO and PACO SPORT on clothing does not infringe upon the rights of defendant Paco Rabanne Parfums (“Paco Rabanne”), in its federally registered trademarks PACO and PACO RA-BANNE.
