The decree appealed from in this canse perpetuates an injunction restraining the defendants, Bragg and Hughes, their agents, servants and employees from digging, excavating or removing the soil from a certain lot or parcel of land, from placing any stone or other building material thereon and from erecting any house or other building thereon,

The plaintiff company owns a large tract of mineral land-dying on the north side of New River and operates a large coal mining plant oh the same and in close proximity to the small parcel of land involved in this controversy. On the…
